The U.S. Court of Appeals for the Federal Circuit (CAFC) vacated a lower court judgment that Life Technologies Corp.’s sequencing instruments infringed Enzo’s U.S. Patent No. 5,449,767, covering DNA sequencing compounds. The appeals court concluded that the patent inventors “were claiming only direct detection” and therefore the district court “erred in construing the disputed claims of the patent-in-suit to cover both direct and indirect detection.” The CAFC remanded the case back to the U.S. District Court for the District of Connecticut to determine if Life Technologies infringed the patent based on CAFC’s claim construction.
