CYGN (Redwood City, Calif.) sued AZA (Palo Alto) in the U.S. District Court in San Francisco, alleging violation of antitrust laws and seeking a declaration of unenforceability and invalidity of an AZA patent covering the transdermal delivery of fentanyl.
CYGN alleges that AZA obtained the patent by misrepresenting the state of the prior art and then used the patent to stifle competition from CYGN's fentanyl patch. Fentanyl is an analgesic to treat severe post-operative pain and chronic pain. ...
